La técnica de reproducción asistida trae consigo un número de embriones sobrantes. Se propone una revisión del estado de la cuestión de estos embriones en el Perú. Se revisa desde las perspectivas biológica, ética y jurídica. Se profundiza en el ordenamiento jurídico peruano, sobre el estado de desprotección de estos embriones y se contrasta con una posible solución: la adopción embrionaria. Se constata el estado de incertidumbre de la situación de estos embriones y se concluye como ilegítima la práctica de (...) la adopción embrionaria, por vulnerar la dignidad y condición de sujeto de derecho del embrión sobrante. Given the grim global statistics of extreme poverty and socioeconomic inequalities, moral and political philosophers have focused on the duties of justice and assistance that arise therefrom. What the needy are morally permitted to do for themselves in this context has been, however, a mostly overlooked question. Reviving a medieval and early modern account of the right of necessity, I propose that a chronically deprived agent has a right to take, use and/or occupy whatever material resources are required to guarantee (...) her self-preservation, or the means necessary to acquire them. There are three individually necessary and jointly sufficient conditions: the need is basic, the claimant does not violate other equally important moral interests, and it is a last resort. I present two recommendations to be followed by the claimants, and offer some examples where this principle may be applied today. I reply to the objections that understanding the right of necessity in this way kills its intuitive plausibility, and that it is a remedy worse than the disease. I conclude that, while not the best solution for the problem of global poverty, the exercise of this right should be accepted if we believe in the human right to subsistence. (shrink)

RESUMO Neste artigo, propomos estratégias de captação de regiões polêmicas em corpus produzido a partir de publicações do Twitter, partindo de quadro teórico que enfatiza a perspectiva dialógica. Com base nessas estratégias, fornecemos entradas para a análise da materialidade oriunda do universo tecnodiscursivo em circulação em ambientes digitais. Em razão da produção do corpus da investigação, avançamos na compreensão de traços que compõem imagens discursivas em torno de Diego Maradona em circulação no Twitter por ocasião de seu falecimento. Para tanto, (...) explicitamos e problematizamos técnicas de captação e produção de um corpus digital de pesquisa, através da delimitação de um espaço discursivo no Twitter que circundou a morte de Maradona. Os resultados obtidos se dirigem tanto às condições de utilização dessas plataformas por analistas do discurso, quanto à cartografia das regiões do dizer que se configuram nesse espaço e dos embates que nelas ganham consistência. En este artículo se presenta un análisis cualitativo preliminar de los contratos laborales firmados entre cuatro músicos de Europa del este y la dirección de la Orquesta Sinfónica de Antioquia en 1949, mientras dichos músicos estaban en los campos de refugiados europeos donde los sobrevivientes de la guerra fueron congregados para su atención y rehabilitación. Con este análisis se pretende problematizar la inserción de estos personajes como agentes de modernización cultural en Medellín, haciendo énfasis en las condiciones políticas y socioculturales (...) que caracterizaban a Colombia a comienzos de la década de 1950. La nacionalidad de estos músicos (tres checos y un rumano) era objeto de sospecha desde la legislación migratoria colombiana, que desde la década de 1920 establecía un catálogo de extranjeros que no debían entrar al país, pues podían traer ideologías contrarias a la defensa de la propiedad privada. Al contrastar estos contratos laborales con la política migratoria colombiana y con la responsabilidad pedagógica cívica que se le imponía a la actividad musical académica, se plantean algunas preguntas para debatir acerca de la narrativa oficial que presenta a estos músicos como agentes de modernidad importados e integrados a un proceso de modernización cuya representación se ha caracterizado por la ausencia de conflicto. Pregnancy presents some interesting challenges for the philosophy of embodied cognition. Mother and fetus are generally considered to be passive during pregnancy, both individually and in their relation. In this paper, we use the enactive operational concepts of autonomy, agency, individuation, and participation to examine the relation between mother and fetus in utero. Based on biological, physiological, and phenomenological research, we explore the emergence of agentive capacities in embryo and fetus, as well as how maternal agency changes as pregnancy advances. (...) We show that qualitatively different kinds of agency have their beginnings already in utero, and to what extent fetal and maternal movement modulate affectivity and individuation in pregnancy. We thus propose that mother and fetus are both agents who participate in pregnancy. Pregnancy then emerges as a relational developmental organization that anchors and holds its developing participants. We end the paper with reflections on ethical implications of this proposal, and suggestions for future research. (shrink)

El texto se detiene en varios aspectos de esa experiencia. We owe to (...) Alexander Gottlieb Baumgarten the introduction of 'aesthetics' into philosophical discourse. At the moment of its inception, however, this discipline had little to do with art and was not primarily concerned with the beautiful. It was instead a theory of the cognitive value of human sensibility—a doctrine of "sensible cognition." A general historical and systematic question presents itself at this point: How shall human sensibility be conceived in order for aesthetics as a theory of sensibility to gain an independence of its own in philosophical discourse? And accordingly: How shall the human being be conceived in order for our aesthetic experience to claim a philosophical value of its own? In this essay, I elaborate the results of the hypothesis that I submit in response to these questions. My claim is that the mind/body dualism dominating the rationalist tradition of modern philosophy is the principal obstacle.. (shrink)

The article is proposed as a reading of A Feminist Theory of Refusal (2021), by Bonnie Honig. Under the assumption that Honig has the merit of introducing into feminist political theory a thought of rejection patiently elaborated from a commentary on literary figures such as Antigone and Bartleby, the article interrogates the logic of resistance that these figurations of negativity advance. From the perspective of A Feminist Theory of Refusal, the names of Antigone and Bartleby are not only subjective indications (...) of the interruption of a domain, but above all they are agonistic figurations of a politics that has the dispute of meaning as one of its main axes. In other words, the politics of rejection that Honig proposes is at the same time an agonal politics that is organized around the meaning of words, of the narratives that structure the commonality of a social order. Following this line of reading, the essay sets out to interrogate the politics of rejection elaborated by Honig from the figurations that embody it. (shrink)

At Universitat Politècnica de València, Meridies, an internship programme that places engineering students in countries of Latin America, is one of the few opportunities the students have to explore the implications of being a professional in society in a different cultural and social context. This programme was analyzed using the capabilities approach as a frame of reference for examining the effects of the programme on eight student participants. The eight pro-public-good capabilities proposed by Melanie Walker were investigated through semi-structured interviews. (...) The internship is an environment in which students can put into practice the knowledge they have acquired in undergraduate studies and to find practical relevance in what they studied. Occasionally, this also entails a critical questioning of what they have learned, a greater awareness of the limits of the contents of their studies and of the way things were taught, and interest in less explored issues that are closely linked to social justice. However, tensions can arise between the pro-public-good oriented perspectives of this programme, and a more instrumental vision. One way to overcome these tensions is to foster consideration of reflexivity, that is, the dynamic relationship between technology and society. To do so, the programme must create space before and during the internship, and upon the return of the students, to discuss and collectively reflect upon their lived experience. Additionally, it ought to engage supervisors in this educational journey, both at the university and in the host institutions, and also involve socially committed organisations in this task. Perception of time is susceptible to distortions; among other factors, it has been suggested that the perceived duration of a stimulus is affected by the observer’s expectations. It has been hypothesized that the duration of an oddball stimulus is overestimated because it is unexpected, whereas repeated stimuli have a shorter perceived duration because they are expected. However, recent findings suggest instead that fulfilled expectations about a stimulus elicit an increase in perceived duration, and that the oddball effect occurs because the (...) oddball is a target stimulus, not because it is unexpected. Therefore, it has been suggested that top-down attention is sometimes sufficient to explain this effect, and sometimes only necessary, with an additional contribution from saliency. However, how the expectedness of a target stimulus and its salient features affect its perceived duration is still an open question. In the present study, participants’ expectations about and the saliency of target stimuli were orthogonally manipulated with stimuli presented on a short (Experiment 1) or long (Experiment 2) temporal scale. Four repetitive standard stimuli preceded each target stimulus in a task in which participants judged whether the target was longer or shorter in duration than the standards. Engagement of top-down attention to target stimuli increased their perceived duration to the same extent irrespective of their expectedness. A small but significant additional contribution to this effect from the saliency of target stimuli was dependent on the temporal scale of stimulus presentation. In Experiment 1, saliency only significantly increased perceived duration in the case of expected target stimuli. In contrast, in Experiment 2, saliency exerted a significant effect on the overestimation elicited by unexpected target stimuli, but the contribution of this variable was eliminated in the case of expected target stimuli. These findings point to top-down attention as the primary cognitive mechanism underlying the perceptual extraction and processing of task-relevant information, which may be strongly correlated with perceived duration. Furthermore, the scalar properties of timing were observed, favoring the pacemaker-accumulator model of timing as the underlying timing mechanism. (shrink)

This idea of dialectic as logic of historical transformation guides the development of consciousness in the emPhenomenology of Spirit/em. Since my claim is that the dialectic of consciousness and its capacity (...) of overcoming contradiction are rooted in the historical situation of 1807, the question is raised of what would be the specific problems encountered by consciousness in our contemporary worldmdash;in 2007. What are the challenges posed by our globalized world to a phenomenology of contemporary spirit; and what is the role that contradiction and dialectic play in the understanding of our own historical present? I offer an argument for what mental action may be like in nonhuman animals. Action planning is a type of mental action that involves a type of intention. Some intentions are the causal mental antecedents of proximal mental actions, and some intentions are the causal mental antecedents of distal mental actions. The distinction between these two types of “plan-states” is often spelled out in terms of mental content. The prominent view is that while proximal mental actions are caused by mental (...) states with nonconceptual content, distal mental actions are caused by mental states with conceptual content. I argue that, when we are investigating animal cognition, we need a nonconceptual account for the content of intentions involved in mental actions such as action planning: non-immediate intentions. This in order to defend the claim that creatures that lack conceptual capacities are capable of entertaining plan-states, and thus of exercising mental agency in the form of action planning. Para las empresas recolectoras de residuos sólidos es indispensable controlar los factores de riesgos asociados a la calidad del aire del entorno laboral de sus empleados con el objetivo de minimizar las afecciones de salud de sus trabajadores. El propósito del estudio es desarrollar un prototipo de un sensor inalámbrico de medición de calidad de aire. Este instrumento de medición será implementado en ambientes laborales para trabajadores de recolección de residuos sólidos. Diversas corrientes historiográficas han consolidado su investigación en torno a actores que no habían sido considerados como sujetos históricos. Éste es el caso de las mujeres. Sin embargo, tal avance disciplinar no se ha visto reflejado en el curriculum de Historia. Este trabajo centra su primera exposición en la ausencia de las mujeres como sujeto histórico en la asignatura de Historia de México en la educación secundaria. En un segundo momento, se propone el uso de archivos documentales como un recurso (...) para dar visibilidad a su participación. Finalmente se presenta, una experiencia didáctica aplicada en un grupo de secundaria en la Ciudad de México. (shrink)

Quilty-Dunn et al. claim that all complex infant and animal reasoning implicate language-of-thought hypothesis (LOTH)-like structures. We agree with the authors that the mental life of animals can be explained in representationalist terms, but we disagree with their idea that the complexity of mental representations is best explained by appealing to abstract concepts, and instead, we explain that it doesn't need to.

Advierte sobre los problemas que tiene México en torno a las instituciones que garantizan la democracia y advierte sobre cuáles son los rasgos de desmocratización que pueden mostrar las encuestas de opinión como la ENCUCI, aplicada en 2020. Hay muchas maneras de entender y practicar la innovación social. En este artículo queremos abordar una perspectiva concreta: la innovación social colectiva (ISC) que busca explícitamente la transformación de los regímenes socio-técnicos. A partir del análisis de dos experiencias que tienen lugar en Valencia (grupos de consumo y una cooperativa energética), caracterizamos el sentido de la transformación de las ISC y su direccionalidad. Para lo primero, se recurre al marco de las transiciones socio-técnicas, mientras que para lo segundo el análisis (...) se realiza desde el desarrollo humano. El análisis arroja diferencias sustanciales en la manera en la que las ISC entienden la producción, las tecnologías, las políticas y regulaciones, la estructura industrial, los canales de acceso y las fuentes de conocimiento, respecto de las prácticas socio-técnicas dominantes. Asimismo evidencia que sus propuestas se alinean claramente con los principios del desarrollo humano y permiten la expansión de capacidades y de agencia.There are many ways to understand and practice social innovation. In this article we touch upon a specific perspective: grassroots innovations (gi) which explicitly seek the transformation of socio-technical regimes. From the analysis of two experiences that took place in the city of Valencia (consumer groups and an energy cooperative), we characterize the sense of the transformation of the grassroots and its directionality. For the former, the framework of socio-technical transitions is used, while, for the latter, the analysis is being made through the human development approach. The analysis reveals substantial differences in the way in which gi understand production, technologies, policies and regulations, industrial structure, access channels and sources of knowledge, compared with dominant socio-technical practices. It also shows that their proposals are clearly aligned with the principles of human development and allow the expansion of capabilities and agency. (shrink)

This article examines the confluence of extractivism, violence, and their resistance in the context of left governance – specifically the case of Ecuador – through an engagement with the concept of populism. Alongside Bolivia and Venezuela, Ecuador has long been associated with the rise of radical populism and with it an ‘autocratic turn’ in Latin America. Dispensing with overdetermined accounts of populism as either the anti-thesis or essence of democracy, this article proposes a third lens – dual populisms – to (...) better grapple with the neocolonial turn toward intensified natural resource extraction and violence. That this intensification took place in the context of a left-in-power in Ecuador was initially surprising given previous alliances between President Correa’s party and Indigenous and environmental movements, and its rejection of capitalist and neoliberal developmentalism. With the expansion of extractive industries, and its accompanying violence increasingly becoming a global phenomenon, dual populism posits a third position – one that is at once top-down, state centered, and also bottom-up and social movement focused – to better account for the complex dynamics at work within this turn. The exact nature of the relation between science and Scripture in the thought of Francis Bacon is a well-studied but controversial field. In this paper, it is shown that Bacon, though convinced that there exists no enmity between the book of God's wisdom and the book of God's power, usually tries to separate knowledge acquired by reason from knowledge acquired by faith. In his exposition of the principle of the conservation of matter, however, Bacon seems to find himself constrained to (...) invoke Scriptural truths in a manner that he usually disapproves of. In order to establish this principle, which is so essential to his overall scientific program, he appeals both to the Bible and Greek mythology in a way that points to certain conceptual tensions within his natural philosophy. En este artículo sobre la poesía testimonial del Caribe colombiano propongo un camino de lectura de los afectos y las imágenes, frente a la violencia y las hegemonías de los discursos pacificadores del siglo XXI. Hago primero un recorrido sobre las tradiciones literarias en relación con la violencia en Colombia. Sin embargo, me centraré en la producción contemporánea, en lo que respecta a publicaciones que se hacen en un momento de posconflicto y de política de la memoria en el siglo (...) XXI. Interpreto la manera en que la imagen poética le responde estética y políticamente a lo que Williams (1980) llamó estructura sentimental de la época. Escojo los poemarios de escritores colombianos caribeños sobre la violencia: “Regresemos a que nos maten amor” (Ariza Navarro 2008), “Al otro lado de la guerra” (Acosta 2014), “Alarmas armadas” (Núñez 2016). Mi tesis es que la poesía testimonial, como flujo estético que viene desde el siglo XX, manifiesta y construye políticas poéticas desde la dialéctica de los afectos, desde la huella de la guerra; se vale de las imágenes para exhibir la violencia, pero crea una sensibilidad que interpela a los lectores sobre lo sentido en una realidad póstuma. BackgroundLow-stakes crimes related to alcohol and/or drugs are common around the world, but research is lacking on police–suspect interactions of such crimes. A large proportion of these suspects are intoxicated during interrogations, and many may have substance use disorder, making them potentially vulnerable to interrogative pressure.MethodsTo address this lack of knowledge, the taxonomy of interrogation methods framework and a common classification of question types were applied in the coding of written police interrogations. Two archival studies, one pilot and one main (...) study analyzed police interrogations with suspects of alcohol- and drug-related crimes in Sweden.ResultsFor both Study 1 and 2, suspects showed signs of alcohol and/or drug intoxication, hangover or withdrawal in more than 50% of all interrogations. In Study 2, additional coding indicated that suspects displayed signs of substance use disorder in 57% of the interrogations. The main results from both studies revealed a large number of direct questions asked by the police across all interrogations, and relatively little use of the strategic interrogation techniques from the taxonomy of interrogation methods framework. In fact, when it came to interrogation techniques, law enforcement used more confrontational techniques in their interactions with intoxicated suspects compared to sober suspects. Furthermore, suspects displaying signs of substance use disorder were significantly more cooperative and prone to confess than suspects without indicators of substance use disorder.ConclusionAs the first novel study on low-stakes crime interrogations related to alcohol and/or drugs, the present study provides useful information about current Swedish interrogation practices and areas for improvement. The study results indicate that suspects displaying signs of intoxication or substance use disorder may be more vulnerable during police interrogations. This may in turn have the potential to inform the development of new interrogation policies. Due to the novelty of this research, more studies are needed, both on a national and international level, to examine interrogations in low-stakes crimes further. (shrink)
